AMALA EARTH and/or its affiliates provide website features and other products and services as an e-marketplace/platform to you when you visit or shop at amala.earth.com, use Amala Earth products or services, or use software provided by Amala Earth in connection with any of the foregoing. 

By accessing or visiting this website, or by using the Platform, you acknowledge that you have read, understood, and agree to be lawfully bound by the contents of these terms & conditions. Unless otherwise specified, these terms and conditions do not apply to third-party products or services, which shall be governed by their own terms of service.

AMALA EARTH provides the Services subject to the following conditions. This user agreement (“Terms and Conditions” or “T&C” or “Terms” or “Agreement”) is between you (“you” or “End User” or “your” or “Buyer” or “Customer” or “Registered User”) and AMALA EARTH (“Company” or “us” or “We” or “amala.earth.com”). This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. In case of a discrepancy or a conflict between the terms mentioned herein below and any other document, the terms contained in the present T&C shall alone prevail for the purposes of usage of the Site.

These terms and conditions govern your use of the marketplace e-commerce website namely https://amala.earth and mobile application, Amala Earth, of Amala Earth (collectively referred to as ‘Platform’). Amala Earth is a brand owned, operated and managed by Passion Tea Private Limited, a company duly incorporated under the provisions of the Companies Act, 1956 and having its registered office at Building No.-E-2 (2nd Floor), Qutub Institutional Area, Shaheed Jeet Singh Marg, Katwariya Sarai, New Delhi, Delhi - 110016 (hereinafter collectively referred to as the (“Company”, “Us”, “We”, “Amala Earth”). 

The domain name amala.earth.com is a brand owned, operated and managed by Passion Tea Private Limited, a company duly incorporated under the provisions of the Companies Act, 1956 and having its registered office at Building No.-E-2 (2nd Floor), Qutub Institutional Area, Shaheed Jeet Singh Marg, Katwariya Sarai, New Delhi, Delhi - 110016 (hereinafter collectively referred to as the (“Company”, “Us”, “We”, “Amala Earth”).

 

RIGHT TO CHANGE

 

AMALA EARTH reserves the sole right to update or modify these Terms and Conditions at any time without prior notice. Therefore, we encourage you to review these Terms and Conditions every time you purchase products from us or use our Website.

We reserve the right to make changes to our site, policies, Service Terms, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

 

USER ACCOUNTABILITY 

 

The user hereby understands and acknowledges that he/she is 18 (eighteen) years of age and is competent to contract under the applicable law(s) and thereby can register on the Platform. We do not permit persons below the age of 18 years to use our Platform without their parent or guardian’s consent or supervision. 

As the User, AMALA EARTH holds that you are solely responsible for maintaining the confidentiality of your User ID and Password. You are responsible for all activities that occur under your User ID and Password. The User shall remain solely responsible for maintaining the confidentiality of his/her registration information and will be liable for all activities and transactions conducted through the User’s account, if provided. The Company shall not be liable for any third party claim with respect to any loss that the User may accrue as a result of someone else using the User’s password or Account, either with or without User’s knowledge. 

The user shall ensure that the registration related information provided by him/her on the Platform is accurate, complete and true. In case AMALA EARTH suspects that the information provided by the User at any time is untrue, inaccurate, or not in accordance with these Terms, the Company shall have the right to suspend, terminate or block his/her access to the Platform. 

Most importantly, the User can only use the Platform for his/her own legitimate, legal use, and neither will attempt to decipher, decompile, disassemble, hack or reverse engineer any part of the Platform, nor assist someone else in doing so.

 

E-COMMUNICATIONS

 

If you are using any of our Services, or send e-mails to us, you are communicating with us electronically. Hence, by using our services, you consent to receive communications from us electronically. We will communicate with you through e-mailers or by posting notices on this site or through other Services. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. The legal requirements would be in conformity with the Indian Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000.

As a condition of purchase, the Site requires your permission to send you administrative and promotional emails. We will send you information regarding your account activity and purchases, as well as updates about our products and promotional offers. You can opt-Out of our promotional emails anytime by clicking the unsubscribe link at the bottom of any of our email correspondences.

Unless it is otherwise indicated or anything mentioned to the contrary or any data regarding proprietary material owned by a third party and so expressly mentioned, AMALA EARTH owns all Intellectual Property Rights for the Website, including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, trademarks, trade names, service marks, designs, know-how, trade secrets and inventions (whether patentable or not), goodwill, source code, meta tags, databases, text, content, graphics, icons, and hyperlinks. By using our website, you acknowledge and agree that you shall not use, reproduce or distribute any content from the Website without procuring due authorisation from AMALA EARTH. 

AMALA EARTH mandates that the user shall not upload, post or otherwise make any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right available on the website. Hence, the user shall be solely liable for any damage resulting from any infringement of Copyrights, trademarks, proprietary rights or any other harm resulting from such a submission.  

In case it is discovered that you are in violation of the aforementioned clauses, you shall be held solely responsible and shall face all legal consequences of the same and AMALA EARTH shall in no manner be held responsible for the same.

REPRESENTATION AND WARRANTIES

  1. We have established an adequate grievance redressal mechanism and have appointed a grievance officer (“Gunjan Jindal Poddar”) for consumer grievance redressal, who shall acknowledge the receipt of any customer complaint within 48 (forty-eight) hours and will redress the complaint within 1 (one) month from the date of receipt of the complaint.
  2. As a marketplace e-commerce entity, We do not impose any cancellation charges on consumers cancelling after confirming purchase unless similar charges are also borne by Us or our sellers, if they cancel the purchase order unilaterally for any reason.
  3. As a marketplace e-commerce entity, We shall only record the consent of a customer for the purchase of any goods or services offered on our Platform, where such consent is expressed through an explicit and affirmative action.
  4. We shall effect all payments towards accepted refund requests of the consumers as prescribed by the Reserve Bank of India or any other competent authority under any law or the time being in force, within a reasonable period of time, or as prescribed under applicable laws.
  5. As an e-commerce entity, We do not:
  6. manipulate the price of the goods or services offered on our Platform in such a manner as to gain unreasonable profit by imposing on users any unjustified price having regard to the prevailing market conditions, the essential nature of the goods or services, any extraordinary circumstances under which the goods or services are offered, and any other relevant consideration in determining whether the price charged is justified; and
  7. discriminate between the users of the same class or make any arbitrary classification of Users affecting their rights.

 

WEBSITE FEEDBACK & USER CONTENT

 

On the Platform, We will provide option(s) for You to leave reviews or ratings. When posting a review, please ensure that:

  • you should have a first-hand experience with the product You are reviewing;
  • your review should not contain offensive profanity, abusive, racist, or hate language;
  • your review should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability;
  • your review should not contain references to illegal activity;
  • you should not be affiliated with the competitors if posting negative reviews;
  • you should not post any false or misleading statements;
  • you may not organise a campaign (whether financial or not) encouraging others to post reviews, whether positive or negative.

 

ADVERTISEMENTS

 

We may facilitate and allow third party advertisers to display their advertisements and other information on our Platform (“Third Party Advertisers”). Any issues or concerns faced by the User with respect to the advertisements will need to be taken up by the User directly with the relevant Third Party Advertiser. We will have no liability with respect to the acts, omissions, errors, representations, warranties or negligence on any part of any Third Party Advertisers. We disclaim any and all liability arising out of Third Party Advertisers’ advertisements on the Platform. Do note that We simply provide the space to place such advertisements, and We have no other relationship with the Third Party Advertisers.

 

BILLING

 

The price of our merchandise as mentioned on www.amala.earth is the Maximum Retail Price (MRP) for the said product. This MRP shall be inclusive of all local taxes as are applicable in India. Additional applicable taxes may be charged depending upon the destination where the order has to be shipped to. The tax rate applied and charged upon the order shall include combined tax rate for both state and local tax rates in accordance with the address where the order is being shipped. AMALA EARTH may also charge delivery Charges which may include postal charges / shipment charges etc applicable for your country for international orders.

 

ORDER CANCELLATION BY US

 

Owing to unavoidable circumstances there may be times when certain orders having been validly placed may not be processed or capable of being dispatched from AMALA EARTH’S end. We reserve the exclusive right to refuse or cancel any order for any such unavoidable or unforeseeable reason. Some situations that may result in your order being cancelled shall include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, problems identified by our credit and fraud avoidance department or any defect regarding the quality of the product.  

There could also be a situation when we may require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your credit card/ debit card/ any other mode of payment has been charged, the said amount will be reversed into your Account/ as the case may be to the source of the payment within a period of 30 working days. 

 

SHIPPING CHARGE

 

The shipping and processing charges are intended to compensate AMALA EARTH for the cost of processing your order, and ensuring its timely delivery. 

 

MODES OF ONLINE PAYMENT

 

AMALA EARTH offers payment options via Visa, Mastercard, Net banking, Cash on delivery, Rupay, RazorPay, PaisaPay, PayPal, Debit/Credit Cards and such other third party facilities, for Payments on the Website. Such payments can be made through the electronic or through Cash on delivery transactions, as specified by us. Use of such third party services will be governed by their User Agreement, Seller Terms, Conditions and other rules and policies as may be required and applicable for your nature of activities. 

When you opt for any payment method/s offered by us, we are not responsible or take no liability of whatsoever nature in respect of any loss or damage arising directly or indirectly to you including but not limited to the following: (a) lack of authorisation for any transaction/s; (b) or exceeding the present limit mutually agreed by you and between your “Bank /s”; (c) or any payment issues arising out of the transaction; (d) or decline of transaction for any other reason/s. 

All payments made against the purchases /services on amala.earth.com by you shall be as against the MRP displayed on the website and shall be in terms and conditions of the third party Online Payment Gateway Services as adopted and applicable to your transaction. 

 

CASH ON DELIVERY

 

“Cash on Delivery” (COD) option available for all products under INR 2000. Plus, it is based on the delivery address Pin code. A collection fees of INR 35/- will be applicable on all the orders below INR 500. 

Any order exceeding INR 2,000 will have to be prepaid.

 

CANCELLATION POLICY

 

The User can cancel the order before the delivery of the products, within 24 hours of placing the order and the refund shall be initiated as per the Refund Policy as stated in the succeeding clause. The User shall make sure that he/she does not accept the order, in case a delivery attempt was made for a cancelled order in compliance with their request for cancellation.

 

RETURN, REPLACEMENT & REFUND POLICY

 

AMALA EARTH endeavours to deliver damage- and defect-free products to the buyers. Any product(s) purchased on our website does not qualify for any return unless the product delivered is damaged/broken or has manufacturing defects. 

Furthermore, products qualify for returns only if:

product(s) delivered does not match the User’s order; or of a different/incorrect size; or the product(s) have already expired or are about to expire (in less than 3 months); or the product(s) delivered were damaged.

User shall ensure that the product to be returned remains unused. The tags and the packaging of the product must be kept intact and untampered by the User.

Products that do not qualify for return are:

  1. products that have been altered or used; or
  2. products whose serial number or bar code has been tampered with; or
  3. if the batch number of the product does not match to that mentioned in the invoice; or
  4. home décor or any larger items: exceeding 1 metre in any one dimension, or weighing more than 10 kilograms.

 

LIST OF NON-RETURNABLE OR NON-EXCHANGEABLE PRODUCTS

 

  • Accessories, including jewellery, bags, scarves, belts, footwear etc.
  • Custom made and Made to order products.
  • Products which were identified/marked as non-returnable or non-exchangeable at the time of purchase.

AMALA EARTH holds the sole discretion to determine whether a refund can be issued. 

 

RETURNS POLICY

 

 The User can return the products within seven days from the delivery of the ordered products. The return will be processed within 10 business days of receipt of return request.

In order to raise a return request within the above-mentioned period, the user is required to send AMALA EARTH a clear picture of the packaging and the product (unless such product is missing) at help@amalaearth.com. We will arrange a reverse pickup for the product and will process the refund as per the Refund Policy.

 

REPLACEMENTS POLICY

 

Replacements will only be allowed in case the products are fashion-related. If the User wishes to replace the product(s) with respect to the colour, quality, size, etc., then the product(s) can be replaced. However, replacements are subject to availability of the particular product and are at the sole discretion of the Company. If the product is not replaced, then it shall be refunded.

Note: We shall process the refund only once We have received the confirmation from the vendor concerned in respect of the contents of the product relating to that refund.

 

REFUNDS POLICY

 

Refunds shall be processed in the mode and manner prescribed below:

  1. the request of the refund shall be validated by the Customer Care Team of Amala Earth
  2. the refund shall only be processed after a confirmation is received from the third party seller concerned in respect to the condition/packaging of the product;
  3. the refund shall be initiated within 10 business days from the date of reverse pickup;
  4. in case of failed attempt at delivery, the product(s) shall be returned to our warehouses. We will then cancel the order and refund the money as per our refund policy.
  5. in case the order is cancelled before the delivery (for prepaid orders), the refund shall be initiated within 7 working days.

 

SHIPPING POLICY

 

We currently deliver across India to all metros and major non-metro cities.

We have tied up with a reliable logistics partner that ensures speedy and damage-free delivery of all products across cities. We strive to ensure that there are no delays in shipments, but sometimes Force Majeure could also play a role.

GENERAL SHIPPING TIMELINES • The seller generally packs the product ordered within 2 business days. In case the product is mode to order, the timelines for getting the product ready are clearly mentioned on the website • Our logistics partners are notified once the vendor has your product ready for dispatch. They pick up the product from the seller and dispatch it to customer location. The general timelines for delivery post pickup is 3-4 days. • Our operations are live across all business days (except Sundays and National Holidays)

INDEMNITY

 

The User agrees to indemnify, defend and hold harmless the Company and its affiliates, officers, directors, employees, consultants, representatives, shareholders, vendors, users, etc. (“Indemnified Parties”) against any/all losses, liabilities, claims, damages, demands, costs, expenses, attorney’s fees or other losses arising out of or in connection with any claim, suit action, or other proceeding brought against the Indemnified Parties.

The Prices displayed on our website may vary from country to country for the same product. Prices shown on the website both for India and in other International Countries are subject to change without prior notice. These prices only reflect the MRP and do not include shipping and taxes which may be extra as applicable.

LIABILITY

 

Amala Earth does not manufacture any of the products that are listed on this Platform. 

Therefore, the User must understand, agree and acknowledge that Amala Earth is an intermediary and online e-commerce marketplace. The ‘contract for sale’ of the products, if any, shall be a bipartite contract between User and sellers enlisted on the Platform.

Any claim that the User may have with respect to the quality, appearance, nature, consumption, usage or any other attribute(s) of the products shall be pursued by the User directly with the seller and Amala Earth shall not be made a party to any such claim. User hereby waives any claim and releases Amala Earth from and against any and all liabilities, losses, claims, damages that may arise out of or in connection with the disclaimer as mentioned in the succeeding clause.

 

DISCLAIMER

 

The Platform is provided on an as-is and as-available basis. You understand and agree that Your use of the platform-based services is at Your own risk. We disclaim all warranties, express or implied, in connection with the Platform and Your use of it, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We make no warranties or representations about the accuracy or completeness of the Platform’s content or the contents linked to this Platform and We will assume no liability or responsibility for the following cases:

  1. Personal injury or property damage, of any nature whatsoever, resulting from Your access to and use of the Platform or the third-party sellers’ products provided therein;
  2. Any unauthorised access to or use of our secure servers and/or any and all personal information and/or financial information stored therein;
  3. Any interruption or cessation of transmission to or from the Platform, &

DISPUTE RESOLUTION

 

This agreement stipulates that the legal relations between YOU and AMALA EARTH shall be determined and governed according to the laws of India. If any dispute arises between you and AMALA EARTH regarding your use of the Website or Your dealing with AMALA EARTH in relation to any activity on the Website, in connection with the validity, interpretation, implementation or breach of any provision of the Terms & Conditions and/or Privacy Policy including but not limited to the rules and policies contained herein, the dispute shall be subject to the exclusive jurisdiction to the Courts of New Delhi.

 

POLICY VIOLATIONS

 

In case AMALA EARTH discovers breach of the Terms of Use or Privacy Policy or other rules and policies or if we are unable to verify or authenticate any information you provide or if it is believed that your actions may cause legal liability for you, other users or us, without limiting to the present, without prior notice immediately limit your activity, remove your information, temporarily/indefinitely, and/or refuse to provide you with access to this Website. Any user that has been suspended or blocked may not register or attempt to register with us or use the Website in any manner whatsoever until such time that such user is reinstated by us.

If you breach the Terms of Use or Privacy Policy or other rules and policies, we reserve the right to recover any amounts due and owing by you to us and to take strict legal action including but not limited to a referral to the appropriate police or other authorities for initiating criminal or other proceedings against you.
